APPTOPUP may, at its sole discretion, modify, stop, or suspend your use of any version of APPTOPUP services and/or disable the APPTOPUP services you have used or installed without notice to you for the purpose of inspecting, improving, and/or upgrading the relevant technology, or for other reasonable reasons; and shall not be liable for any direct or indirect damages caused by the release or non-release of new versions of APPTOPUP services.
4. In any of the following circumstances, APPTOPUP has the right to interrupt or terminate the services provided to you without notice:
(1) According to law, you should submit true information, but the personal information provided by you is untrue, or inconsistent with the registration information and you fail to provide a reasonable certificate;
(2) You violate relevant laws, regulations, or the provisions of this agreement;
(3) As required by law or by a competent authority;
(4) For security reasons or other necessary circumstances.
You are responsible for backing up the data stored in the Services by yourself. If your service is terminated, APPTOPUP may permanently delete your data from the server. After the service is terminated, APPTOPUP has no obligation to return the data to you.
XVII. Legal Jurisdiction
1. This Agreement is signed in HONGKONG and UK.
2. The establishment, entry into force, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of HONGKONG and UK (excluding conflict of
laws).
3. If any dispute or controversy arises between you and APPTOPUP regarding the content of this agreement or its implementation, you should first make every effort to resolve it through friendly consultation; if the consultation fails, you agree to submit the dispute or controversy to the people's court with jurisdiction in the place where this agreement was signed.
4. The titles of all clauses of this agreement are for ease of reading only and have no actual meaning and cannot be used as the basis for interpreting the meaning of this agreement.
5. If any provision of this agreement is held to be invalid, void, or unenforceable for any reason, such provision shall be deemed severable and shall not affect the validity and enforceability of any other provision, which shall remain binding on both parties.
6. Other rights not explicitly authorized in this agreement are still reserved by APPTOPUP, and you need to obtain APPTOPUP's written permission when exercising these rights. APPTOPUP's failure to exercise any of the foregoing rights shall not constitute a waiver of such rights.
XVIII. Terms for Minor Users
1. APPTOPUP attaches great importance to the protection of personal information of minors. If a user is under 18 years of age, they are a minor and should read this agreement and use our products and services under the supervision and guidance of a guardian. APPTOPUP protects the personal information of minors in accordance with relevant national laws and regulations.
2. Minor users should pay attention to the following matters when using the Services, improve safety awareness, and strengthen self-protection:
(1) Recognize the difference between the online world and the real world, and avoid being addicted to the internet, which may affect daily study and life;
(2) Strengthen personal protection awareness when filling in personal information to prevent bad actors from harassing personal life;
(3) Learn to use the internet correctly under the guidance of guardians or teachers;
(4) Avoid casual meetings with strange online friends or participating in social activities to prevent lawbreakers from taking advantage and endangering personal safety;
(5) Guardians and schools should provide more guidance to minors when using the Services. In particular, parents should care about the growth of their children, pay attention to communication with their children, and guide them on the safety issues that should be noted when surfing the internet, so as to prevent problems before they occur.
3. We will not take the initiative to directly collect personal information from minors. For the collection of personal information of minors with the consent of guardians, we will only use, share, transfer, or disclose such information when permitted by law, with the consent of guardians, or when necessary to protect minors.
4. If there is evidence that minors have registered and used our products and/or services without the consent of guardians, we will negotiate with the relevant guardians and try to delete the relevant personal information as soon as possible.
XIX. About Payment
According to this agreement, if you choose to pay by credit card, the purchased goods and/or services will be processed by the Hong Kong or UK acquirer. These terms are the agreement between you and Element Colors Electronic Entertainment Limited (Company No: 68033215-000-08-20-1, Address: Rm 1601, Chow Tai Fook CTR, No.580A-F Nathan Road, Mong Kok, Kowloon, Hong Kong.). The goods and/or services will be provided by Element Colors Electronic Entertainment Limited.
